RICHARDS EQUIPMENT COMPANY

Net 10th prox., all past due accounts will be charged a finance charge of 1� % per month (annual percentage rate of 18%) or legal maximum amount by law. All accounts shall be payable on the due date at the location indicated on the invoice for such material and after maturity shall be payable in Waco, McLennan County, Texas. If all or any part of the account is placed in the hands of a collection agency, or an attorney for collection, or if suit is brought on same or if collected through probate, bankruptcy, or other proceedings, then the applicant/purchaser agrees to pay reasonable collection and/or attorney�s fees connected with such proceedings. Salesperson�s authority is limited to solicitation of orders and custom service. All orders are subject to acceptance by Richards Equipment Company.

Richards Equipment Company reserves the right to limit dollar amount of purchases. Large sales And/or special orders may require deposits and/or special terms as agreed upon in writing.

Accounts past due will be placed on "COD" or "HOLD" until all outstanding balances are paid. An account may be closed if in the opinion of management it is for the best interest of Richards Equipment Company.

RETURN OF MERCHANDISE:

STOCK ITEMS:

Return of stock merchandise will be accepted only with our prior approval.

Merchandise must be returned in the condition in which it was purchased and must be accompanied with a copy of the original invoice. Unless otherwise agreed, a restocking charge of 15% will be imposed for the return of stock merchandise.

SPECIAL ORDER ITEMS:

Special order merchandise will be accepted for return only when

Richards has the prior consent of the source from which the goods were purchased. Any freight, restocking, reconditioning, or similar charges assessed by the supplier will be borne by the customer.

All charges are due and payable at the offices of Richards Equipment Company in Waco, McLennan County, Texas.

Prices are subject to change without notice. Market sensitive commodity type products are priced according to current market conditions.

WARRANTY TERMS

Most of the products listed in Richards catalog or website are warranted to the final consumer by their manufacturer. Copies of such warranties are supplied with the product or are available from the manufacturer. Richards Equipment will obtain copies of consumer warranties from the warrantor and will furnish them free of charge to customers who request them. Address request to:

Richards Equipment Company, P.O. Box 1878, Waco Texas 76703. Request must include the Richards invoice number and the manufacturer�s model number of each product for which a copy of the warranty is requested. Richards can also furnish sales brochures and other literature of the manufacturer. Richards Equipment Company assumes no responsibility for the content such warranties or sales literature by performing this service.

RICHARDS LIMITED WARRANTY

LIMITED WARRANTY

All products sold are warranted by Richards Equipment Company

(Richards) only to purchases for their use or for resale or for use in business or original equipment manufacture, against defect in workmanship or materials under normal use for the period of time allowed by the manufacturer of the product from date of purchase from Richards. Any product which is determined by Richards and/or the manufacturer to be defective in material or workmanship and returned to Richards, shipping cost prepaid, will be, as the exclusive remedy, repaired or replaced at Richards and/or Richards supplier option.

WARRANTY DISCLAIMED

Richards has made a diligent effort to illustrate and describe the products in this catalog accurately, however, such illustrations and descriptions are for the sole purpose of identification, and do not express or imply a warranty that the products are merchantable, or fit for a particular purpose, or that the product will necessarily conform to the illustrations or descriptions. No warranty statement above is made or authorized by Richards and/or Richards suppliers.

LIMITATION OF LIABILITY

Any liability for consequential and incidental damages expressly disclaimed.

Richards liability in all events is limited to, and shall not exceed, the purchaser price paid.

PROMPT DISPOSITION

Richards will make a good faith effort for prompt correction or other adjustment with respect to any product which proves to be defective within warranty period. Before returning any product to Richards refer to terms and condition section of this catalog for the correct procedure for returns. Title and risk of loss pass to buyer on delivery to the common carrier.

If product was damaged in transit, recipient must file claim with carrier.

PRODUCT SUITABILITY

Many states and localities have codes and regulations governing sales, construction. Installation, and/or use of products for certain purposes, which may vary from those in neighboring areas.

While Richards attempts to assure that its products comply with such codes, it cannot guarantee compliance, and cannot be responsible for how the product installed or used. Before purchase and use of a product, please review the product application and national and local codes and regulations, and be sure that the product installation and use will comply with them.

NO WARRANTIES TO CONSUMERS

Richards makes no warranties to those defined consumers in the Magnuson-Moss warranty - federal trade commission improvement act.
